Terms of service

To join the Untagged community and to buy and sell items on Untagged you must first accept our terms and conditions. These terms and conditions are set up to protect Untagged members and to build trust on the platform.

Your data: The personal information collected from you in the sign up process is so that we can contact you in relation to the Untagged service and the Untagged community.

Definition of Buyer: A buyer is someone who buys an item on the site with Untagged tokens (TT).

Definition of Seller: A seller is someone who lists an item for sale on the site.

Definition of Token: Tokens are the Untagged currency used within the app. Tokens can be acquired by selling items, completing actions (‘Missions’) on the app, and receiving gift boxes. They have no external value outside of the app.

Seller: When listing an item to sell, you agree that the item is as described in the listing, and you are legally able to offer the item for sale.

Buyer: When buying an item, you are responsible for paying the postage costs, and ensuring the item received is as described by the seller. If not you will report this to the seller, and to Untagged.


General terms & conditions

1) Access to Personal Contact Details

By signing up to Untagged, permission is given to Untagged to contact me in relation to Untagged services using the personal details that I have shared.

I acknowledge that I can remove my data and information from the Untagged platform at any time by contacting support@untaggedfashion.com and requesting this, and that Untagged can provide me with all of my recorded data within 30 days of a request for access to my data.

2) Personal responsibility on the platform

These terms and conditions outline an agreement between buyer and seller. Untagged is not a party to the agreement when buying and selling clothes and the buyer/seller are solely responsible for any loss or damage to any item.

3) Age

You must be at least 13 years of age and capable in your country of residence of entering into a legally binding agreement to use Untagged. Untagged does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the app. Untagged's content is not directed at children under the age of 13. Children under the age of 13 are prohibited from providing any personal information to the Site. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. 

4) Platform usage and safety

I acknowledge that when uploading images and information to my public profile that these images and information are available on the world wide web. Before uploading anything please consider what kind of images and information you would like to share.

I acknowledge that if I feel unsafe or intimidated on the Untagged platform that I will report this immediately to Untagged team.

5) Code of conduct

I agree that as a member of the Untagged Community I will respect all members on the platform and will not take part in any activity that bullies or abuses another member in any way.

I acknowledge that if there are accusations of bullying or abuse made against me that my account will be suspended and the matter will be reported to the police.

I acknowledge if it is found that I have used Untagged as a platform to bully or abuse another member that I will be immediately removed from the platform.

6) Rules of Use

In using Untagged, I agree that I will NOT:

1. Create more than one Account on Untagged unless we agree otherwise.
2. Give any false or misleading information in my Account details.
3. Use the Service if we have suspended or banned you from using it.
4. Send junk, spam or repetitive messages.
5. Engage in any illegal or unlawful conduct including selling or intentionally purchasing any fake or counterfeit items or any item that otherwise breaches another person’s rights
6. Modify, interfere, intercept, disrupt or hack the app.
7. Misuse the app by knowingly introducing viruses, Trojans, worms, logic bombs or other material which would harm the app or any user of Untagged's own equipment.
8. Submit or contribute any User Content (including comments and descriptions relating to Sale Items) that contains unlawful content, nudity or violence, is abusive, bullying, threatening, harassing, obscene, misleading, untrue, offensive, defamatory, derogatory or uses bad or rude language, as Untagged may decide in its absolute discretion. Untagged has a zero tolerance policy in this regard.
9. Submit or contribute any User Content without the permission of the content owner, or otherwise infringe the copyright, trademark or other rights of third parties (which includes using hashtags for protected brands, in connection with your listing, that are irrelevant to such listing). 

10. Offer to sell or buy any of the items we list as prohibited items. Untagged has a zero tolerance policy on using its App to promote, advertise or sell drugs, drug paraphernalia, tobacco and/or tobacco paraphernalia or related products.

7) Tracking and optimisation

By signing up to Untagged, permission is given to Untagged to use Facebook pixels, Google Analytics, and Firebase (app analytics and feedback tool) to track conversions on the platform and optimize our platform processes.


Full Terms and Conditions

1.Untagged’s role in agreement

Untagged is a service which facilitates buying and selling between users for virtual currency (TT). Untagged is therefore not responsible for any loss or damage to any item. Untagged is not a party to the contract of agreement.

2.Selling an item

(i) I confirm that the images provided by me and description of any item I am selling on Untagged are a true reflection of the item and its condition.

(ii) I confirm that I own the item and/or the item can be legally offered for sale.

(iii) I confirm that I will assign a token value to my item using the guidelines shared with me by Untagged.

(iv) I understand that when someone buys my item, I will receive payment in tokens (TT), and will not receive any cash payment.

(v) I confirm that I will only make 1 listing per item.

(vi) I confirm that the postage costs I assign to the item for sale will genuinely reflect the actual costs of posting the item to the buyer.

(vii) If after sale, the item is found to not match the description I have given, or does not meet Untagged’s guidelines for sale, I am responsible for reimbursing the buyer their postage costs, and will cover the cost of any postage should I want the item to be returned to me. The token value I have received from the seller for the item will also be removed from my account.

3. Buying an item

(i) I confirm that I can only buy an item on the site if I have sufficient tokens (TT) in my account.

(ii) I understand that the buyer is responsible for the cost of postage, which must be arranged direct with the seller. Payment can be made by PayPal, bank transfer, or another payment method agreed between buyer and seller.

(iii) I understand that once I commit to buy an item, the tokens will be removed from my account.

(iv) If the item is not as described in the listing when received, the buyer must contact the seller to make them aware of the issue, and also contact Untagged Customer Services at support@untaggedfashion.com, providing photos of any issues.

(v) If it is the case that the claim is correct, the buyer will be reimbursed the token value. The seller is responsible for reimbursing the postage costs, and for covering any postage should they want the item to be returned. Untagged is not liable for the postage cost.

4.Procedure for reimbursement in case of damage/loss:

(i) If damaged or not as described in the listing, the buyer must prove that the garment is in an unsatisfactory state by providing photos of the item to the Untagged team.

(ii) Once Untagged has confirmed the item is damaged/unsatisfactory, they will reimburse the buyer the token value of the item.

(iii) The buyer must contact the seller to arrange for their postage to be reimbursed, and to agree whether or not the item should be returned (cost to be covered by the seller). If payment for the original postage was made through Paypal (recommended), the buyer can file a dispute with Paypal for reimbursement of their costs.

(iv) If an item is not received, the buyer must contact the seller to check the item was sent and ask for proof of postage. With proof of postage they must then contact the delivery provider and follow their process for compensation.

(v) If there is no proof of postage, the buyer must contact the Untagged team who will agree with the buyer a suitable resolution.

5.Access to Personal Contact Details

By signing up to Untagged permission is given to Untagged to contact me in relation to Untagged using the personal details that I have shared.

6.Tokens

(i) Tokens are for indicative purposes only and cannot be exchanged for money.

(ii) Tokens do not expire.

(iii) Sellers decide on the token value of the item they are selling. Untagged provides guidance on the app on how to price an item.

(iv) Untagged has the authority to cancel tokens for any reason effective upon sending notice to you at the email address you provide whilst registering or such other email address as you may later provide to us.

(v) Tokens have no value outside of the Untagged app and must not be sold on or transferred to other users. Any breach of this will result in the user immediately being removed from the platform and they will forfeit any tokens they may have.

(vi) Tokens are non-transferrable.

(vii) If for any reason your membership is terminated, you are not entitled to any tokens accrued.
